This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Aviate Software LLC ("Company," "we," or "us") for the use of the "GA Kneeboard" software ("Software"), a template creation utility for kneeboard sheets provided as a Software as a Service (SaaS).
By accessing or using the Software, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not use the Software.
Subject to the terms of this Agreement, the Company grants you a non-exclusive, non-transferable, revocable license to access and use the Software for your personal or business use.
2.1 Data Accuracy: You acknowledge and agree that you are solely responsible for confirming the accuracy of all data provided in the Software from official sources, including but not limited to the Federal Aviation Administration (FAA). The Company does not guarantee the accuracy, completeness, or reliability of any data within the Software.
2.2 Compliance: You agree to use the Software in compliance with all applicable laws, regulations, and FAA guidelines.
3.1 No Warranty: The Software is provided "as is" without warranty of any kind, express or implied. The Company disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
3.2 Limitation of Liability: To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use the Software.
3.3 Accidents and Incidents: You expressly agree that the Company shall have no liability whatsoever in the case of any accident or incident (as defined by the FAA) in connection with the use of the Software. You assume all risks associated with the use of the Software in aviation-related activities.
4.1 Data Access: You have the right to access your data as outlined in our Privacy Policy. The Company will maintain and provide access to your data in accordance with the terms set forth in the Privacy Policy.
4.2 Data Security: While we implement reasonable security measures, you acknowledge that no method of transmission over the Internet or electronic storage is 100% secure. You use the Software at your own risk.
The Company reserves the right to terminate or suspend your access to the Software at any time, with or without cause, and with or without notice.
The Company reserves the right to modify this Agreement at any time. Your continued use of the Software after any such changes constitutes your acceptance of the new terms.
This Agreement shall be governed by and construed in accordance with the laws of the state of Washington United States, without regard to its conflict of law provisions.
By using GA Kneeboard, you acknowledge that you have read, understood, and agree to be bound by this End User License Agreement.
